Phase I/Phase II ESAs
Environmental due diligence is especially important today because society is more litigious and environmental regulators are more diligent in their pursuit of parties responsible for contamination than ever before. The Environmental Site Assessment (ESA) process is use to identify Recognized Environmental Conditions (RECs) related to past and/or current use of property that may pose a risk to a buyer, lender, and/or investor (Phase I) and to confirm the presence or absence of potential contaminants (Phase II). Performance of and appropriate ESA will allow an owner to rely on the innocent Landowner Defense if and environmental problem with the property is discovered in the future.
